Personal information being processed and what for
Personal information is required to follow the legal process of recovering the charge applied following the issue of a Penalty Charge Notice and for the purchase and issuing of a season ticket or resident permit. Some information will have been provided directly by you but we will only collect personal information we need to perform our functions. The data we may collect includes, but is not limited to the following:
- Name
- Address
- Vehicle registration number and DVLA documents
- Utility Bills (for processing of resident permits)
- Contact details including phone numbers and email address
- Financial details
Why we are allowed to use your information
We use your personal data only where we have a lawful basis to do so. This could because the law tells us to do so, such as The Traffic Management Act 2004 - Parking Enforcement. It could also be because we do so within the powers given to us in undertaking our public task of administering parking across Cheshire East. These powers come from legislation such as the Road Traffic Act 1984 - On Street resident parking schemes.
Who we will share your information with
Cheshire East Council may share your information with our service providers, who include but are not limited to enforcement agents, Police, security organisations or any other enforcement or prosecuting authority to prevent or detect crime.
Your personal information may also be shared with regulatory and statutory bodies as required by law, such as to prevent and detect crime or fraudulent activity, ward members (Councillors), MPs and internally with colleagues from other Cheshire East Departments
Where we get your information from
We will collect the vehicle registration numbers, keeper details as recorded with the Driver and Vehicle Licensing Authority (DVLA) and any details of correspondence between parties involved in the case.
We will gather your information provided by you either directly into Parking Services, via Customer Services or internally with colleagues from other Cheshire East Departments.
We also receive your personal data from third parties, for example in letters from MPs , Councillors, Town/Parish Councils or independent charities i.e. Citizens Advice Bureau/Christians Against Poverty where you have asked an official person or organisations to act on your behalf.
Vehicle and parking session details provided by our mobile parking provider, should you use our cashless parking solution (telephone, web or app).
How long we will keep your personal information
For enforcement purposes we will keep your personal information for a maximum 7 years. We are required to keep this information because of the statutory obligations between the DVLA and the British Parking Association and in order to meet our financial and court evidence requirements.
For season ticket and permit data we will keep your records for a maximum 6 years.
How your information is stored
Data will be stored within the Cheshire East ICT system for Parking Services with secure access for authorised officers only.
If you don’t provide us with your information
We cannot determine your right to a permit, administer a season ticket or make a decision on an informal appeal. In such cases outstanding Penalty Charge Notices would progress through the formal route with DVLA involvement.
Your information will not be used to make automated decisions
Your rights
You have a number of rights regarding your personal data, including withdrawing your consent where we have asked for it. You can also ask for a copy of the information we hold about you and ask us to correct anything that is wrong.
